Shortly after midnight (evening of 14 April 2004), the French Senate concluded its debate on the section relating to telecommunications of the "Projet de loi Communications électroniques - Services de communication audiovisuelle".

The text adopted by the Senate contains material differences compared to the text which was adopted by the Assemblée Nationale on 12 Feb 2004.

Given the urgency (the deadline for transposition of the EU directives on electronic communications was 24 July 2003), a special reconciliation committee, involving members of the Assemblée and of the Senate, will now be formed, to come up with an agreed final legislative text. A similar reconciliation procedure will be followed for the "Projet de loi pour la confiance dans l'économie numérique (LCEN)".

On the contentious issue of the powers of the regulatory authority relating to ex-ante retail tariff control, the Senate adopted amendment n°300, which reads as follows:

Rédiger le second alinéa du II du texte proposé par cet article pour l'article L. 38-1 du code des postes et télécommunications comme suit :

"Elles ne sont pas applicables sur les marchés émergents, notamment ceux créés par l'innovation technologique, sauf s'il est porté atteinte aux objectifs mentionnés à l'article L. 32-1. En ce cas, l'Autorité de régulation des télécommunications ne peut imposer les obligations prévues au présent article que par une décision motivée prise après avis du Conseil de la concurrence, dans un délai de trois semaines suivant cet avis".
